He doesn't want to do it and he's figured out, somewhere, that he doesn't have to always do it if he behaves like a jackass. (I think he also has your number.. if you have bum leg or arm.. a horse CAN, and WILL figure that out and take advantage of it. They do it amongst themselves, never doubt that they do it with people.)

I've only ever had to deal with one full out turd (3yr old, half-spoiled, pony, filly) like that.. I got a lunge line with a chain and ran it thru the rings of her halter and then clipped the chain back to the base of the lungeline (gives you something with some bite and a pretty quick release) and a good lunge whip with a few knots in the end.  Soon as the ears would twist back and she got that look.. I behaved like an insane, fucking, banshee.
One round pen session of that and she decided that it just wasn't worth it. Next session.. all I had to do was hiss. Third session.. if I gave her the look and stepped toward her.. hindquarters were back against the roundpen and she was a lady. ...After that she was pie.

....probably would be considered absolutely disreputable behavior on here, but a pinched chin and a filly that was under the conviction for several days that I might turn into a giant bat and eat her alive.. was a helluva lot better than hooves flying at my crunchy parts.

A horse like that, if that behavior is allowed to continue (and isn't reprimanded in the MOST thorough way possible) could seriously hurt you. All it takes is one hoof to your head or your face and you're a vegetable.
They don't even necessarily have to be "meaning" to land a kick.. Shit happens.
  
Aggressive behavior should not be tolerated. I will put up with a horse that kicks out and away from me if he hurts. Hell, I'll put up with certain nervous kickers. But I will not put up with open aggression like that.
