I would bet money that jump is using breakaway cups, in which case it's not going to be a problem. Just that the photo has caught the horse just as it's about to drop onto the rail, within another half a second the weight bearing down on the rail would cause the cups to drop away.

It's obviously a big show - big jump, rider & horse attire, size of the crowd in the background etc. The back rail at the very least would have the FEI approved safety cups, possibly every single rail on every single jump. Designed just for situations like this!
