My opinion, not that it's worth much as a non-lawyer..I don't see that it's a problem that he walked down twice before. I mean, his dog might have run through via the trail, and you said the agreement was no motorised vehicles so when you flooded it was probably quicker to walk through. Anyway they seem legit. reasons that you might be pissy about but they aren't the end of the world. Obviously with the bulldozer thing they are out of line and it violated the terms of the agreement (no motor vehicles) so - BIWAP or OPL or someone? - would that void it and cancel it???? Either way you probably have grounds to get it sorted. (disclaimer: non-lawyer). But, I don't understand why, when you realised you needed an agreement with different neighbours instead, you didn't sort it out/cancel it 8 yrs ago?
