But doesn't it make a difference if EVA bought the property when the other house was already there? Isn't that part of what's supposed to happen in a sale? As in, the prospective buyers are supposed to know if their property is "clear" or if there's an issue with encroachment?

We're sort of in the opposite position. The property next to us is an undeveloped lot. We have a pole barn (here when we bought the house) that is very, very close to their property line (if you look at the platt map). Now, I *hope* the previous owners did their job and made sure that it wasn't, but we didn't do a survey when buying the house. So I fully realize that, some day, the owners of that property can say "Hey, it's on our line, move it."

We've met the owners of the property and we're hoping that, one day, when they decide to sell the property, they'll let us offer for it first.
