Long story short.....
I broke my well used rule about using equine contracts and did some business with a friend, almost 4 years ago.
A good friend.
After many visits and looking for a good Fjord for her to ride, I sold her a beautiful mare, Fjreda.
I had really wanted to keep Fjreda and breed her to Leidjo. He was getting older ( 26 ) and they had already had one beautiful filly for me, PF Fjern.
I sold Fjreda to Sharon Lundquist Brown and Franklin Brown of Tonopah, AZ. for a discounted price and a baby back. Win, win I thought.
Bred Fjreda, didn't take. Gave them one more cycle to get it done, she caught. Leidjo's last foal, turns out.
Sent a now bred Fjreda to AZ and also sent along my sweet red dun Fjord mare, DOLLY, who was loaned for their kids to ride.
DOLLY had done some therapeutic riding on loan to the National Ability Center, who wanted to buy her, but she was not for sale. A perfect push button babysitter.
Fast forward, a filly was both May 10th, 3 years ago this week. A beautiful strong, healthy filly. Thrilled is a huge understatement.
Soon after, all the pictures and videos and statements started turning into " I love her....I cant part with her....what do you want for her... "
( Lots of smiley faces, winks and hahahaha's ) At first. In one day, shortly after I made it clear to the continuing remarks about keeping her, that she was not for sale.
Next day I woke up to silence. Everything gone. All e-mails, going back years. All photos, all videos, all posts gone off horse boards we shared. All deleted, removed, no nada.
Basically for the next 2 years, we have been in court, working on getting our Fjords back. Across State lines, no contract......really bad judgement on my part.
We were told that if we came to get our horses they would call the Maricopa Co Sheriffs on us. The Sheriffs ( Sheriff Joe ! ) told us that unfort. it was now a civil case, but as soon as we won them back
they would escort us out to pick them up. We hired an attorney.
Fast forward a year or so. Small communications with them wanting to keep both PF Fjreya and DOLLY. Nope. Finally, we received a registered letter in the mail. We thought they were sending us money for them.
Nope. They sued us in Small Claims court in AZ for BOARD, feed, ect. Quite a bit too.
Sooooo, Jeff had to go off to AZ and appear in Small Claims court there.
Sharon testified in circles for awhile and the judge interrupted her and asked her " who owns these 2 horses ? " She couldn't answer and asked for a recess to speak to her husband.
When she came back she told the judge that the 2 Fjords belonged to them. He said that he was not going to make someone else pay for HER horses and it was over as soon as it started.
BEST part of the AZ court case ? She was on tape. Lying. Also.....the sheriff deputy that had attempted to serve them with our REAL UTAH court case was finally ( after many many trys ) able to get her served.
In court. BAM. She ( and we ) were thrilled.
Fast forward to very recently. We finally had our court action come up and we went to trial. Here. They both lied on the stand....we were shocked at the storys she esp told.
We had people testify for us that knew the story, they brought no one. She admitted lying in the AZ court case and gave the explanation " I was just trying to spur things along as the Pedersens wouldn't give us a price
for the Fjords. " So, basically blackmail and purgery. The judge was not impressed and awarded us back both horses. She was also ordered to pay court costs and for all the attempted services by the sheriffs there.
She was further ordered to " cooperate with the transfer of the horses, to be done within 30 days " * of his signing his ruling.
They didn't cooperate. The hauler and vet we hired in AZ to pick up the horses were flat turned down at their door, following us giving 2 weeks notice of them arriving. Turned away.
We re-scheduled and our attorney said that if it happened again, we would go back into court and ask that they have them delivered. They were picked up.
No halters or leads, standing in a make short round pen in their front yard, no help, they stood and watched as the vet and her hauler struggled to load the 3 yr old.
We got a call that they were safely at the vet clinic in Buckeye. But.....there was a problem. The Fjords were in " horrible " shape. This from the vet.
DOLLY is ribby, hips protruding, backbone sharp, neck wasted away and flopped over to lack of muscle tone. Her hoofs are terrible and she is lame.
Fjreya suffered worse treatment. She is going to be 3 yrs old in 3 days. She is the size of my weanlings. Only my waenlings are sturdy, strong and huge. Huge bloated wormy belly and so full of sand that the vet said she is only giving her
a guarded prognosis. Shes been eating dirt. For a long long time. She has no neck, her head looks huge and she has no muscle tone to her at all. Stunted. Has diarrhea which the vet said was from all the sand.
No hoof care, she is weak.
I will post pictures later. Not too many people here knew of our efforts at getting these 2 Fjords back.....but for those who did and gave support, advice ect. THANK-YOU.
